Report and Consent Approval

A Report and Consent approval is required for works that involve a variation to the siting provisions of the Building Regulations.

The information that is required by council to process your application is:

  1. Details showing compliance with the Ministers Decision Guidelines.
  2. A plan showing the subject allotment, adjoining buildings, relevant elevations and sections as required by the regulations
  3. Written comments from the affected adjoining property owners (please consult with the Municipal Building Surveyor for further direction)
  4. A copy of the 'Certificate of Title' showing any current covenants or Section 173 agreements under the Planning & Environment Act 1987 that may apply to the subject allotment.
  5. Application fee for dispensation request plus $100.00 for each additional regulatory dispensation request (please refer note below)

The State government has developed and implemented a set of Building Regulations (commonly referred to as 'ResCode' by the building construction industry) to govern the siting of domestic dwellings, outbuildings and fences for projects not subject to the provisions of the Planning & Environment Act 1987.

If an application does not meet the regulation objective and Decision Guidelines, then Clause 4A(2)(d) of Schedule 2 of the Building Act 1993 requires that the reporting authority must refuse consent.

Each of the following provisions comprises a statement of the objective and matters to be considered in deciding if the objective of a Building Regulation is met.
