Fences
Irrespective of whether a building permit is required or not, all fences must comply with the building regulations.
Dividing Fences
Issues relating to fences located between neighbours are a civil matter. This means that any issues are to handled between the neighbours themselves and not council. In the occurrence of a dispute where neighbours cannot agree please contact the Dispute Settlement Centre on 9603 8370 who will be able to assist you.
Side fences can be 2m high and 1.5m high within 3m of the front boundary without a Building Permit.
A Building Permit is required for any fence exceeding 2 metres in height and whenever it is proposed to vary from the Building Regulations through the Consent and Report process.
Front Fence
If you wish to build a front fence on your property you must first determine what materials you would like to use as this effects the regulation height of your fence. Colourbond and timber front fences can be 1.5m in height without a Building Permit whereas brick front fences can only be 1m in height without a Building Permit. If you wish to have a fence higher than what is stated in the Building Regulations, you will be required to apply for a Building Permit.
If you have an easement at the front of your property then you will be required to apply for an Over Easement Consent.
To determine if you have an easement at the front of your property you will need to refer to your Title. If you do not have a copy of your Title you can apply to the Land Titles Office on 9603 5555.
Corner Fence
Corner properties have extra requirements for front and side fences. A maximum height of 1m is allowed within 9m of the Point of Intersection, 1.5m on the front boundary and 2m on the side boundary. See below for an illustration.
Fences adjoining Council owned land
Council contributes half the cost of fencing for properties adjoining land that Council holds title to as per the Fences Act 1968. Please contact the Depot on 9401 0555 for more information.
